Chapter 8, Section J:
Transfers in the Event of Divorce

Revised August 13, 2008

In the event of a divorce, transfer of title can be accomplished on the strength of the final divorce decree, issued by the court.

The decree must be a certified copy and must stipulate that the described vehicle was awarded to the title applicant. The decree must contain the court seal. The description of the vehicle must include the VIN.

The license plate goes with the individual declared by the court to be the legal owner, but only if his or her name is already on the title as an owner. If the plate is a special plate, the new sole owner must also meet any special requirements for issuance of the plate. Example: if the plate is a POW plate, the new sole owner may only keep the plate if he or she is a qualifying POW.
